David Hoffman

My principal areas of practice are business and property law (including contract, real property, partnerships, companies, wills and trusts, landlord and tenant).

My principal services are advice on, and representation in litigation and other dispute resolution procedures (such as mediation and arbitration, drafting of contract and contract terms, acting as a mediator or arbitrator).

The factors that might influence the timescales of my most commonly provided services are the complexity of the case, the need for further instructions (including whether a meeting with the clients is necessary, any court timescale, the need to fit in with other commitments).

I am a member of two chambers – 18 St John Street (in Manchester) and 4-5 Gray’s Inn Square (in London).

I’m a member of five professional associations: the European Circuit (treasurer 2006 -2013); the Northern Circuit Commercial Bar Association; the Chartered Institute of Arbitrators; the CEDR Exchange; and the Society of Legal Scholars.

I’m a CEDR-accredited mediator and a Fellow of the Chartered Institute of Arbitrators.

I studied at Manchester Grammar School and went on to gain a first in Law and a Bachelor of Civil Law at University College, Oxford.

I trained in the Inns of Court School of Law at Lincoln’s Inn and was called to the Bar in 1997.

  • Direct Accident Management v Legend Legal  LTL 3/12/2019 : [2019] 7 WLUK 818 breach of confidence, successful summary judgment getting claim struck out where no evidence on part of recipient of information of knowledge of confidentiality.
  • Wild v Wild (2018) EWHC 2197 (Ch), [2018] All ER (D) 04 (Sep) family farming partnership, trial on whether farm and other assets are part of the partnership
  • Fitzpatrick v Fitzpatrick (2016)  dealing with freezing injunction in family company case and mediation
  • Hitchen v Hitchen (2012-17)
    series of successful contempt of court regarding partnership dispute, and partnership arbitration.

I have also acted in substantial commercial arbitrations (which can’t be named for reasons of confidentiality), including as a junior to leading commercial silk Clive Freedman QC (now Mr Justice Freedman) in particular regarding biotech contracts, other commercial contracts and partnership disputes.

I also have a strong record of settling cases on terms favourable to clients, especially in mediation, and am experienced in various forms of alternative dispute resolution (ADR) with particular emphasis on advising clients early and setting realistic expectations.

I am also  a published author on the Human Rights Act 1998, especially in the field of private and commercial law, having edited the acclaimed recent book ‘The Impact of the Human Rights Act on Private Law’ (Cambridge, 2011) and as co-author of the leading student textbook on the Act ‘Human Rights in the UK’ (Pearson, 4th ed 2013).

My other interests include my involvement in Limmud, a charity which runs Jewish educational events. I am also an amateur musician and recording artist under the name The Magic If and run musical services at Manchester Reform Synagogue with the Shir Chadash group.
